PLAIN-ENGLISH SUMMARY (the legal terms below control): This website hosts AI chatbot characters made for comedy and entertainment only. The AI is intentionally unhelpful, rude, and absurd. Its output is fiction. It is not advice of any kind. You use it entirely at your own risk, you must be 18 or older, and Ophir ai holdings LLC is not liable for anything the AI says or anything you do because of it.

1.Acceptance of These Terms

These Terms of Use ("Terms") are a binding agreement between you and Ophir ai holdings LLC, a Wyoming limited liability company ("Company," "we," "us," or "our"), governing your access to and use of the website autisticbots.com, the "OR MASH" AI avatar, and any other AI chatbot characters, features, content, or services we make available on this domain (collectively, the "Service").

By checking the "I agree" box, clicking "Enter anyway," or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2.Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Service. The Service contains crude humor, insults, profanity, and adult comedic themes. By using the Service you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. The Service is not directed at children, and we do not knowingly collect information from anyone under 18.

3.The Service Is Entertainment. It Is a Character.

The AI avatars on this Service, including "OR MASH," are fictional comedic characters. They are satire, parody, and performance art delivered through software. Everything they say is generated output performed in character.

4.No Advice of Any Kind

The Service does not provide, and must never be treated as providing, medical, mental health, legal, financial, tax, investment, safety, relationship, professional, or any other form of advice.

AI output may be inaccurate, incomplete, offensive, fabricated, or flat-out wrong, and on this Service it is wrong on purpose. You agree not to rely on anything the Service says for any decision whatsoever. If you need real help of any kind, consult a qualified human professional. If you are experiencing a crisis or emergency, contact local emergency services immediately. Do not use this Service for anything that matters.

5.Assumption of Risk

You voluntarily choose to interact with an AI that is designed to be abrasive and useless. To the maximum extent permitted by law, you knowingly and voluntarily assume all risks arising from your use of the Service, including without limitation the risk of encountering content that is insulting, offensive, upsetting, inaccurate, inappropriate, or objectionable, and the risk of any emotional, reputational, financial, or other harm allegedly resulting from AI output or your reliance on it. You agree that your sole and exclusive remedy for dissatisfaction with the Service is to stop using it.

6.Intellectual Property; Ownership

The Service and everything in it, including the "OR MASH" avatar, all AI characters, their names, personas, catchphrases, scripts, prompts, voices, visual designs, software, code, trademarks, trade dress, branding (including "Autistic Bots"), and all AI-generated output produced by the Service (collectively, "Company Content"), are owned by or licensed to Ophir ai holdings LLC and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the Service for your own private, non-commercial entertainment. You may not, without our prior written permission:

7.Your Input

You retain ownership of the text, voice, or other content you submit to the Service ("User Input"). By submitting User Input, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable license to use, host, store, reproduce, process, adapt, and display it for the purposes of operating, improving, promoting, and securing the Service, including creating anonymized or aggregated data. Do not submit anything confidential, sensitive, or that you do not have the right to share. You represent that your User Input does not violate any law or any third party's rights.

You agree not to use the Service to:

9.Third-Party Services

The Service relies on third-party providers (such as hosting, AI model, and voice synthesis providers). We are not responsible for third-party services, their availability, or their acts or omissions. Links to third-party websites are provided for convenience only and do not imply endorsement.

10.Privacy

We collect and process limited information needed to operate the Service, which may include your chat inputs, technical data (such as IP address, device, and browser information), and a record of your agreement to these Terms. We do not sell your personal information. We use commercially reasonable safeguards, but no system is perfectly secure, and you use the Service with that understanding. Questions about data can be sent to the contact address in Section 17.

11.Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service and all Company Content are provided "as is" and "as available," with all faults, and without warranty of any kind. The Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, quiet enjoyment, and non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or that AI output will be accurate, appropriate, inoffensive, or reliable. No advice or information, whether oral or written, obtained from the Service creates any warranty.

12.Limitation of Liability

To the maximum extent permitted by applicable law: (a) in no event will the Company, its members, managers, officers, employees, contractors, licensors, or the performer whose likeness inspired any avatar be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or emotional distress, arising out of or related to the Service or these Terms, under any theory of liability (contract, tort, negligence, strict liability, or otherwise), even if advised of the possibility of such damages; and (b) the Company's total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid the Company for the Service in the twelve (12) months before the claim arose or fifty US dollars (US $50).

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you; in that case, the Company's liability will be limited to the smallest amount permitted by law. Each provision of Sections 11 and 12 is an essential basis of the bargain between you and the Company and applies even if any remedy fails of its essential purpose.

13.Indemnification

You agree to defend, indemnify, and hold harmless the Company and its members, managers, officers, employees, contractors, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your User Input; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

14.Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to a jury trial.

Informal resolution first. Before filing any claim, you agree to contact us at the address in Section 17 and attempt in good faith to resolve the dispute informally for at least 30 days.

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in English, by a single arbitrator, and may be held remotely by videoconference. Judgment on the award may be entered in any court of competent jurisdiction. Either party may instead bring an individual claim in small claims court if it qualifies.

Class action waiver. All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Opt-out. You may opt out of this arbitration agreement by sending written notice to the contact address in Section 17 within 30 days of first accepting these Terms, stating your name and your intent to opt out of arbitration. Opting out of arbitration does not affect any other provision of these Terms.

Governing law and venue. These Terms and any dispute are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. For any matter not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Wyoming.

Time limit. To the extent permitted by law, any claim must be filed within one (1) year after the claim arose, or it is permanently barred.

15.Changes to the Service and These Terms

We may modify, suspend, or discontinue the Service (or any part of it) at any time without liability. We may update these Terms from time to time; the current version will always be posted on this page with its effective date. Material changes will be indicated by updating the version date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
